Terms of Service

When you use Everett, you agree to these Terms of Service (“Terms”). If you break them, we may suspend or close your account.

We may update these Terms from time to time. When we make a meaningful change, we'll update the date above and email the address on your account. Continuing to use Everett after a change means you accept the new Terms.

Definitions

“Company”, “we”, “our”, or “us” means Seattle Thinking Tools LLC, a company organized under the laws of Washington.

“Service” or “Everett” means the Everett product and any website we run for it, including everett.tools, whether delivered in a web browser, a browser extension, or any other form.

“Content” means anything you save into Everett: web pages, PDFs, notes, images, highlights, questions, stances, and the text of anything you write there.

“You” or “your” means the person who owns an Everett account.

Account terms

  1. You must be at least 18 years old to use Everett.
  2. You are responsible for keeping your login secure, including any third-party sign-in (such as Google) you connect to your account. We are not liable for loss or damage that results from someone else using your credentials.
  3. You are responsible for everything saved to and done under your account.
  4. One person per account. Please don't share logins.

Payment, refunds, and plan changes

  1. If you're on a free plan, it's free. We don't ask for a card and we don't sell your data.
  2. When you upgrade to a paid plan, we charge your card right away and your billing cycle starts that day. Other plan changes take effect at the start of your next billing cycle.
  3. Prices don't include taxes. Where we're required to collect tax, we'll add it and pass it on; otherwise, taxes are your responsibility.
  4. If you're unhappy in your first 30 days on a paid plan, email us and we'll refund you in full, no questions asked. After that, we don't prorate partial months.

Cancellation and termination

  1. You can cancel any time from Settings → Account. Cancellation takes effect immediately and you won't be charged again. Emailing us isn't a cancellation by itself, but we'll always help if you get stuck.
  2. You can export your library before you cancel: Settings → Account. “Export everything” gives you a zip of your original content - including notes and highlights - plus a JSON index.
  3. When you cancel, we delete your account and everything in it right away. It's gone and we can't get it back, so export first if you want to keep anything.
  4. We may suspend or close your account, and refuse future use of Everett, for any reason at any time. Suspension means you can't get in. Termination means we delete the account and its content. We'll give you notice and a chance to export where it's reasonable to do so.
  5. Abuse or threats toward anyone working on Everett will get your account closed immediately.

Changes to the service and prices

  1. Everett is new and will change. We may add, change, or remove features at any time, with or without notice. If we ever shut Everett down, we'll give you at least 30 days' notice so you can export your library.
  2. If we change prices for existing customers, we'll email you at least 30 days before the new price applies.

Uptime, security, and privacy

  1. You use Everett at your own risk. We provide it “as is” and “as available”. We don't offer a service-level agreement, but we take uptime seriously and we'll tell you when something's wrong.
  2. If your usage is far above normal and it's affecting other people, we may throttle or temporarily disable your account. We'll contact you first unless we need to act right away to keep the Service running.
  3. We protect your data with encryption in transit, encrypted backups, and access controls. If you believe we have a security vulnerability email us: hello@everett.tools.
  4. We process your data only as described in our Privacy Policy. Our staff may look at your content only:
    • to help with a support request you've made, and with your permission;
    • to fix an error that stopped an automated process partway through, and only the minimum needed;
    • to investigate abuse or protect the security of the Service; or
    • when we're legally required to. We're a U.S. company with data hosted in the U.S., and we only hand over data in response to a valid legal order.
  5. We rely on third-party providers for hosting and for some processing (currently DigitalOcean for hosting and OpenRouter for AI features).

Your content and ownership

  1. Your library is yours. Everything you save or write in Everett remains your property. You give us only the limited license we need to store, process, display, and back up your content in order to run the Service for you. We don't use your content to train AI models, and we don't sell it.
  2. You're responsible for what you save. You must have the right to store any web page, PDF, or image you capture into your library, and everything you save must comply with U.S. copyright law. Saving material for your own personal reference is generally fine; redistributing it from Everett is not. If you think someone's Everett content infringes your copyright, email hello@everett.tools and we'll respond as the DMCA requires.
  3. We don't pre-screen content, but we may remove content or close accounts that violate these Terms.
  4. Everett itself — its code, design, and name — belongs to us. Using the Service doesn't give you ownership of any part of it. Ask before using the Everett name or logo for anything public.

AI features

  1. Everett uses machine learning and third-party AI models to suggest connections between your items, propose typed relationships, draft answers grounded in your library, and raise counter-questions. To do this, we send relevant portions of your content to our AI provider (OpenRouter) for processing. We route requests only to providers with zero-data-retention policies, so your content isn't stored by them or used to train AI models. We don't send your whole library; we send only what's needed to answer a given request (for example, the related passages the model synthesizes into an answer).
  2. These suggestions are exactly that: suggestions. They can be wrong, incomplete, or confidently mistaken. The conclusions you draw are your own, and you're responsible for anything you decide or publish based on them. Everett is not legal, medical, financial, or professional advice.
  3. Everett labels what the machine proposed, what came from your sources, and what you wrote. Don't present machine-generated text as something you authored where that distinction matters.

Acceptable use

Don't use Everett to:

If we offer an API or extension, its use is covered by these Terms too. Excessive or abusive API use may get your access limited without notice if it's affecting the Service.

Liability and governing law

To the fullest extent the law allows, the Company is not liable to you or to anyone else for damages of any kind arising from your use of Everett, from any inability to access your data, from unauthorized access to your account, from AI-generated suggestions, or from the actions of any third party. If we are found liable despite this, our total liability is limited to the amount you paid us in the 12 months before the claim.

These Terms are governed by the laws of the State of Washington, and any dispute will be resolved in the state or federal courts located in King County, Washington. If any part of these Terms is found unenforceable, the rest still applies. These Terms, together with our Privacy Policy, are the whole agreement between us about Everett.
